Texas RioGrande Legal Aid seeks justice for San Antonio man killed by Bexar County Sheriff Deputy
Update: On March 21, 2022, a grand jury indicted Sheriff Deputy Brandin Moran for shooting and killing Jesus Benito Garcia.
SAN ANTONIO – Nearly two years ago, Jesus Benito Garcia was shot and killed in his home by Bexar County Sheriff’s Deputy Brandin Moran. Mr. Garcia’s family now seeks to hold Deputy Moran and the Bexar County Sheriff’s Office (BCSO) accountable for the unjustified and needless killing of their husband and father. On March 3, 2022, they filed a suit in federal court for the violation of Mr. Garcia’s constitutional rights.
On March 9, 2020, Sergeant Reyes of the Elmendorf Police Department responded to a disturbance call regarding the Garcia home. As Sergeant Reyes entered the home, he found Mr. Garcia pleading with his wife not to leave him. Mr. Garcia had a screwdriver to his own neck in a gesture of self-harm. Sergeant Reyes was alone with Mr. Garcia and his wife for several minutes using de-escalation techniques attempting to peacefully resolve the situation. Suddenly, Bexar County Sheriff’s Deputy Moran burst through the front door and within mere seconds fired his weapon seven times without warning. Five bullets hit Mr. Garcia, who was kneeling next to his wife. Ms. Garcia was so close to her husband that when Deputy Moran shot him, he fell on top of her.
After shooting Mr. Garcia, Deputy Moran did nothing to help him. BCSO policy requires officers to provide medical assistance in such situations. Moran had extensive training, including first aid and CPR. But Moran ignored BCSO policy and his training and rendered no aid to the man he had just shot. Deputy Moran only radioed into dispatch that “I got one,” and then paced back and forth for approximately seventeen minutes as Mr. Garcia lay bleeding on the floor.
EMS then arrived and quickly began CPR and provided medical care. Twenty-six minutes later, Mr. Garcia was pronounced deceased. He is survived by his wife, three daughters, and two sons.
Despite promises of transparency and efficiency from the Bexar County District Attorney’s office, including the creation of a civil rights division, two years after Deputy Moran killed Mr. Garcia, the family is still waiting. Although the Garcia’s have requested documents about Mr. Garcia’s death, including body camera footage and the autopsy report, the BCSO and District Attorney’s office has blocked the release of that information, citing a pending criminal investigation. But despite repeated representations to the family that Mr. Garcia’s killing would be presented to a grand jury, the DA has yet to take action. All the while, the Garcia family has waited for answers and for justice. Today, they are taking steps to find those answers and to hold those responsible accountable.
In the lawsuit filed by Mr. Garcia’s family, his relatives seek accountability from both Deputy Moran and Bexar County. They ask the federal court to find that Deputy Moran violated Mr. Garcia’s right to be free from excessive use of force and his right to potentially life-saving medical assistance. The lawsuit also asserts a claim against BCSO for failing to update its use-of-force policy, even though it was aware that the policy was constitutionally inadequate and that other Bexar County residents had been killed by BCSO officers under it. The family believes that the failure to update the policy played a direct role in Mr. Garcia’s death.

SAN ANTONIO – Hace casi dos años, Jesús Benito García fue asesinado a tiros en su casa por el sub- sheriff del condado de Bexar, Brandin Moran. La familia del Sr. García ahora busca responsabilizar al Oficial Moran y a la Oficina del Sheriff del Condado de Bexar (BCSO) por el asesinato injustificado e innecesario de su esposo y padre. El 3 de marzo de 2022, presentaron una demanda en un tribunal federal por la violación de los derechos constitucionales del Sr. García.
El 9 de marzo de 2020, el sargento Reyes del Departamento de Policía de Elmendorf respondió a una llamada de disturbios con respecto a la casa de García.
